A very desirable 1766 first edition of a highly significant primary document from the Stamp Act crisis. Its pages contain perhaps the most robust and aggressive articulation of the British Crown's claim to the taxation of the American colonies issued during the crisis itself. It was published in London, anonymously, just as Parliament was debating whether to repeal the widely detested Stamp Act. The work is a fierce, uncompromising defense of parliamentary supremacy and its issuance played a direct role in the American Colonies' decision to formally declare their independence.

Most gallingly to the American Patriots, the tract is explicit in its rejection of the singular colonial rallying cry and demand, "no taxation without representation." The author counters the American slogan with the doctrine of "virtual representation," i.e. asserting that the Parliament represents the global interests of the entire British Empire, and that the Americans are a part of that Empire, and that they are therefore represented . . . just not by someone who specifically represents "them."

In the broader context of the American Revolution, this publication perfectly encapsulates the rigid constitutional standoff that made the Revolutionary War inevitable; absolute parliamentary sovereignty versus colonial self-governance. The fundamental disagreement articulated here ultimately made the political rupture between Great Britain and America irreparable and hostilities imminent.

Very scarce on the market. The last example offered at auction was at Ahlers & Ogletree, 2024 where it hammered for just over $8,000 with commissions.

Our sale price for it as it is. For an additional $450.00, our binder binder is happy to put this in an appropriate half leather binding or in an appropriate archival chemise and slip case.

[American Revolution. Stamp Act]. The Justice and Necessity of Taxing the American Colonies, Demonstrated. Together with a Vindication of the Authority of Parliament. London. Printed for J. Allon, opposite Burlington-House in Piccadilly, 1766. First Edition. 36pp.

A textually very good copy, complete with half title, title, and crisp through to the end of the text on p.36. Evidently bound into a larger sammelband at some point, now removed with minor remaining flotsam on spine. First two leaves are loose, very minor losses to half title as shown.
